1. General
These Terms and Conditions apply to all purchases made through this Philips Sound Shop (“https://www.sound.philips”) for delivery within the Netherlands, Belgium, France, Germany, Italy, Austria, Spain and Portugal. Sales are conducted by Philips Nederland B.V., registered at High Tech Campus 52, 5656 AG Eindhoven, the Netherlands, Chamber of Commerce registration number 17039420 (“Philips”).
By placing an order, you confirm that you have read and agree to be bound by these Terms and Conditions. Philips reserves the right to amend these Terms and Conditions at any time. Any changes will not affect orders placed prior to the publication of the revised Terms on this Website.
2. Orders and Contract Formation
Orders can be placed online by completing the order form and confirming the purchase via the checkout process.
Once you have submitted your order, you will receive an order confirmation by email. The agreement between you and Philips is concluded at the moment the order confirmation is sent.
Philips reserves the right to refuse, limit or cancel any order, for example in the event of suspected fraud, payment irregularities, limited stock availability, or where a product has been listed at an incorrect price due to a technical, administrative or pricing error. Philips may also limit the quantity of products supplied to a single customer, household or delivery address.
3. Prices
All prices are displayed in Euros (€) and include VAT and any applicable environmental or disposal fees.
Shipping and handling costs, if applicable, will be clearly indicated during checkout before the order is confirmed.
4. Payment
You may pay for your order using one of the payment methods made available during checkout. The payment methods available depend on the country of delivery and may change from time to time.

Credit card payments (Visa and Mastercard) will be charged when the order is processed for shipment.
Philips may verify the cardholder's identity before processing the transaction.
Payments made using iDEAL, Wero, Bancontact / Mister Cash, PayPal or other immediate payment methods are charged when the order is placed.
If Philips is unable to fulfil your order, any payment received will be refunded using the original payment method.
Philips will not begin processing your order until payment has been successfully authorised.
5. Delivery
Orders can be delivered to addresses located in the Netherlands, Belgium, France, Germany, Italy, Spain, Portugal and Austria.
Products are shipped to the delivery address specified during checkout. Delivery dates provided by Philips are estimates and non-binding.
Philips cannot be held liable for delays beyond its reasonable control.
Title and risk of loss transfer to the customer upon delivery of the products.
If one or more ordered items are out of stock, Philips will notify you and, where applicable, cancel or partially fulfill your order.
Once your order has been dispatched, Philips will send you a shipping confirmation by email, including tracking information where available.
If tracking information indicates that your order has been delivered but you have not received it, you should notify Philips Customer Support as soon as reasonably possible and no later than ten (10) business days after the indicated delivery date. Philips will investigate the matter with the carrier.
6. Right of Withdrawal and Returns
You have the right to withdraw from the purchase within 30 days without providing any reason. The withdrawal period expires 30 days after the day on which you (or a third party designated by you) take physical possession of the product.
To exercise your right of withdrawal, you may also submit your withdrawal electronically using our withdrawal button. This button is clearly visible and easily accessible on our Website throughout the entire withdrawal period. The withdrawal button is also directly accessible via https://www.sound.philips/en/pages/information-about-withdrawal/information-about-withdrawal/. After clicking the withdrawal button, you will be redirected to our online withdrawal process, where you can submit your withdrawal electronically. You will receive confirmation of receipt by email without undue delay.
Upon withdrawal, Philips will refund all payments received, including standard delivery costs (excluding additional costs arising from a non-standard delivery method chosen by you), without undue delay and within 14 days of being informed of your decision to withdraw.
Refunds will be issued using the same payment method you used for the original transaction, unless expressly agreed otherwise. Philips may withhold reimbursement until the goods have been received or proof of return has been provided.
You must return the goods within 14 days after notifying Philips of your decision to withdraw. During the withdrawal period, you must handle the product and packaging carefully and only use or inspect it to the extent necessary to determine its nature, characteristics, and functionality.
The right of withdrawal does not apply to:
- Products made to your specifications or clearly personalized;
- Sealed products that are not suitable for return for health protection or hygiene reasons, once unsealed;
- Digital content not supplied on a tangible medium, if performance has begun with your prior express consent and acknowledgment that you thereby lose the right of withdrawal.
Where Philips provides a return label, returns made in accordance with the provided instructions will be free of charge.
If the customer chooses an alternative method of returning the products, the direct costs of returning the goods shall be borne by the customer.
If your product is defective upon delivery or develops a defect during the applicable warranty period, please contact Philips Customer Support before returning the product. Philips will assess the issue and provide instructions for repair, replacement or return where applicable.
Philips will bear the costs of returning products that are confirmed to be defective under warranty.
7. Warranty
Philips offers a warranty on its products in accordance with the terms stated on the warranty certificate supplied with the product and/or published on the Website.
If a product fails to conform to the applicable warranty, Philips will, at its discretion, repair or replace the product or refund the purchase price upon return.
For products manufactured by third parties, only the statutory warranty or the manufacturer’s warranty applies.
If digital content proves defective, you are entitled to repair, replacement, or, if not possible, a full or partial refund.
These warranties do not affect your statutory rights under applicable consumer protection laws.
8. Liability
Philips’ total liability for any claim arising from the purchase or use of products is limited to the purchase price paid for the relevant product.
Philips shall not be liable for indirect, incidental, or consequential damages such as loss of income, profit, or data.
Nothing in these Terms shall exclude or limit Philips’ liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.
Nothing in these Terms limits or excludes any mandatory consumer rights under applicable law.
9. Force Majeure
Philips will make every effort to fulfill its obligations under the agreement but cannot be held responsible for delays or failures resulting from circumstances beyond its reasonable control (including natural disasters, strikes, transport disruptions, or governmental actions).
In such cases, Philips will perform its obligations as soon as reasonably possible.
10. Data Protection
Philips processes personal data in accordance with its Privacy Policy, which is available on the Website.
Your personal data will only be collected, processed and used for the purpose of fulfilling your order, providing customer service, complying with legal obligations and, where applicable, for other purposes for which you have provided your consent.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by Dutch law.
If you are a consumer residing in a Member State of the European Union, you also benefit from any mandatory consumer protection provisions applicable in your country of residence.
Any disputes arising out of or in connection with these General Terms and Conditions shall be submitted to the competent court in accordance with the applicable laws.
Nothing in these General Terms and Conditions limits your statutory rights to bring proceedings before the competent courts of your country of residence where such rights are granted under mandatory law. Philips Nederland B.V. is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. We prefer to resolve your concerns directly with you.
12. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No failure by Philips to enforce any provision shall constitute a waiver of that right.
This document constitutes the entire agreement between you and Philips regarding the purchase of products via the Website.
Philips may transfer this agreement to an affiliated company at any time.
Product descriptions, specifications, images and colours are provided for illustrative purposes only.
While Philips makes every effort to ensure accuracy, slight variations may occur due to manufacturing changes, display settings or product updates.
Such variations shall not constitute a defect.
